This privacy statement applies to the services provided by Awon Europe B.V. (“Awon Europe”, hereinafter also referred to as “we”, “our” or “us”). Awon Europe is registered with the Chamber of Commerce under number 97890693 and is located at Professor Lorentzweg 16, 5144 NP in Waalwijk.
In this privacy statement, we inform you about how we collect, use, share and protect the personal data we process about you. We process your personal data in the context of our services in line with the relevant legislation, such as the General Data Protection Regulation (“GDPR”).
1. Personal data we process
We collect your personal data at various times. Below you can see what data we collect and for which purposes. We also indicate our legal basis for each data processing category.
Contact
When you contact us by telephone, by email or through the contact form on our websites with a question or request for information, we process your name, telephone number and/or email address, as well as any additional information you provide in your message, in order to answer your question or fulfil your request. We retain this data as long as necessary for answering your question or request and will delete this data no later than nine months after finalising your question or request, unless we have another purpose for retaining the data. Our legal basis for this data processing is our legitimate interest to assist our current and future customers as well as the performance and preparation of a contract.
Registering as a potential partner
When you contact us or register on behalf of your company to become a potential partner, we process the following data:
- Company name
- Company address
- Chamber of Commerce number
- First and last name
- Telephone number
- Email address
- Any other data you provide to us in this regard
We process this data to gain an understanding of your organisation and to explore the possibilities for a collaboration. We may also need this data to contact you about a possible collaboration. We will retain your data for a maximum of six months after our last contact, unless we enter into a partnership with you. Our legal basis for this data processing is our legitimate interest to build our partner and dealership network as well as the performance or preparation of a contract.
Authorised dealers and distributors
To enter into a dealer or distribution contract, we process the following data about you:
- Company name
- Company address
- Chamber of Commerce number
- VAT number
- Payment details, such as bank account information
- First and last names of contact persons
- Telephone numbers
- Email addresses
We require this information to conclude and perform the contract, draw up invoices, and communicate with you. We may also need this information to perform a credit check and to comply with our legal obligations. We retain this information for a maximum of two years after the partnership agreement has ended unless we are legally obliged to retain this information for a longer period. Our legal basis for this data processing is the performance of the dealer contract.
To place orders with us as a dealer or distributor, you may use our online order portal. For this portal, we process your login credentials and your activities in our portal, such as your new, current and upcoming orders, login activities and historical changes to your account.
Customers
When you (either for yourself or on behalf of your company) purchase a product directly from us, we process your personal data in order to perform the contract. We use this data to send you updates on your order, prepare the invoice, arrange the payment and arrange the delivery. We process the following data for this purpose:
- Company name
- Company address
- Chamber of Commerce number
- VAT number
- Bank account details
- First and last names of contact persons
- Telephone numbers
- Email addresses
We store this information for a maximum of two years after the agreement has been concluded unless we are legally obliged to store this information for a longer period. Our legal basis for this data processing is the performance of the purchase contract.
Complaints and warranty handling
If you have purchased a product from us directly or through one of our distributors, a certain warranty period applies. If you contact us about a defect in the product, we may process the following data:
- Company name
- Company address
- First and last name of contact person
- Telephone number
- Email address
- Invoice
- Identification numbers on the product
We require this information to verify whether the defect occurred within the warranty period. We also require this information to contact you and further process the complaint. We store this information for a maximum of twelve months after the complaint has been handled, unless we are legally obliged to store this information for longer. Our legal basis for this data processing is the performance of a purchase contract.
If you exercise your warranty through one of our distributors or dealers, it is possible that we receive your personal data from them to further handle your warranty claim.
Job applications
If you apply for a job with us and/or send us your resume and cover letter, we may process the following data:
- Name
- Address
- Telephone number
- Information about the education, courses and internships you have completed
- Information about the nature and content of your previous and/or current employment
- Languages you speak
- Any other data you may share with us in this regard
We will use this information to assess whether you are suitable for the position. We may also consult information about you which we receive from third parties, such as your references or on the basis of a governmental declaration of your behaviour (“VOG”), if this is relevant to the position. We will process this data on the basis of your consent, to comply with a legal obligation, on the basis of a legitimate interest or in preparation of a possible employment contract.
Your data will not be retained longer than necessary and will in any case be deleted by us no later than four weeks after the application procedure has ended. With your consent we may retain your application data after the application procedure has ended for a maximum of one year to keep you informed of new, relevant vacancies. This only applies if we do not enter an employment contract with you.
Website visitors
We may process personal data for our legitimate interest to analyse and improve our website and our services. For this purpose, we may use cookie technology on our website. For more information on our use of cookie technology, we refer you to the cookie banner and cookie policy on our website.
2. Sharing data
We only share your personal data with third parties if this is necessary for the performance of our services, if we have a legitimate interest in doing so, or if we are legally obliged to do so. We will only share data with third parties on a need-to-know basis. We may share your personal data with the following types of partners:
- Logistics partners: We share your data with our logistics partners so they can deliver your orders.
- Payment providers: We share your data with our payment providers so we can process your payment.
- Service providers: We share your data with our own service providers so we can offer our services to you. These include service providers who help us host our website and support our IT systems.
- Service partners: We share your data with our service partners that assist us with handling your guarantee claims and/or complaints with regard to our products.
- Manufacturers and engineers: We share your data with our manufacturer and/or partner engineers so they can design and manufacture your product.
- Government agencies: We share your data with government agencies when we receive a request to do so and are legally obliged to share the data.
We never sell your personal data to third parties for commercial purposes.
In principle, we do not process your personal data outside the European Economic Area ("EEA"). If we do process your data outside the EEA, for instance if we send one of our products to you directly from our facility in China, we ensure that this processing complies with the requirements of the relevant privacy legislation, such as the GDPR. We only process your data outside the EEA if we have taken sufficient safeguards to ensure that your personal data is protected to the same level as within the EEA.
3. Security
We take appropriate technical and organisational measures to protect your personal data against loss, theft and unauthorised access. This includes the use of secure servers, data encryption and access control. If we use the services of data processors that process your personal data on our behalf and on our instructions, we will enter into a data processing agreement with them to ensure that these processors offer the same level of protection of your personal data.
4. Your rights
You have the following rights regarding your personal data:
- Access: You can request access to your personal data as well as a copy of the personal data we process about you and information about how we process your personal data.
- Correction: You can request us to correct any inaccurate or incomplete data.
- Deletion: You can request us to delete your data.
- Objection: You can object to the processing of your data for certain purposes, such as direct marketing.
- Restriction: You can request us to restrict the processing of your data in certain situations.
- Portability: You can request to receive your data in a structured, commonly used and machine-readable format.
- Withdraw your consent: If we process your personal data on the legal basis of your consent, you always have the right to withdraw your consent, after which we will stop processing your personal data on that legal basis. Any processing we performed prior to the withdrawal of your consent will remain lawful.
We do not use automated decision-making.
You can send us a request to exercise (one of) the rights above by sending a message via the contact form or by contacting us using the contact details mentioned at the end of this privacy statement. If we receive a request from you to exercise (one of) these rights, we will respond within one month. If your request is complex or we have received many requests from you, we may extend this period by two additional months. We will notify you of this extension if applicable. If necessary, we will first ask you for additional information so that we can verify your identity.
We may reject your request. You always have the right to lodge a complaint with the national data protection authority. 5. Amendments
This privacy statement may be amended without prior notice in the event of changes in the business operations and/or privacy policy of Awon Europe. It is therefore advisable to consult this privacy statement regularly. The changes will be announced on the website.
